1. Acceptance of Terms

By accessing and using the Visual With Mohit website and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services. These terms apply to all visitors, clients, and users of our services.

2. Our Services

Visual With Mohit provides performance marketing services including but not limited to:

• Meta Ads (Facebook & Instagram) Management
• Google Ads Management (Search, Shopping, Performance Max)
• Social Media Management & Content Creation
• Graphic Design Services
• Video Editing & Production
• Follower Growth & Engagement Strategies
• Performance Marketing Consulting

All services are managed personally by Mohit Kumar, the sole specialist. We reserve the right to modify or discontinue any service at any time.

3. Payment Terms

Service fees are outlined in your service agreement. Key payment terms include:

• Payment is due as specified in your service agreement (typically monthly in advance)
• We accept payments via bank transfer, credit card, or agreed methods
• All fees are non-refundable unless otherwise specified in your agreement
• Ad spend budgets are separate from management fees and paid directly by client
• Late payments may result in service suspension

Note: Ad spend is managed through your own advertising accounts. You retain full control and ownership of your ad accounts at all times.

4. Client Responsibilities

As a client, you agree to:

• Provide accurate and timely information needed for campaigns
• Grant necessary access to advertising accounts, websites, and analytics platforms
• Review and approve campaign materials within reasonable timeframes (typically 24-48 hours)
• Pay fees as agreed in the service agreement
• Comply with advertising platform policies (Meta, Google, etc.)
• Communicate changes to business goals or strategies promptly

5. Intellectual Property

All content, materials, and intellectual property created during our engagement remain the property of Visual With Mohit until full payment is received. Upon payment, you receive a license to use the deliverables for your business. You retain ownership of your business data, ad accounts, and customer information. Unauthorized use, reproduction, or distribution of our work is prohibited.

6. Limitation of Liability

Visual With Mohit shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our maximum liability is limited to the amount paid for services in the preceding 12 months. We do not guarantee specific results, and performance depends on multiple factors including your product, market, and creative assets.

7. Termination & Cancellation

Either party may terminate the service agreement with written notice as specified in your agreement:

• Monthly retainers: 30 days written notice
• One-off projects: Termination before delivery may incur charges for work completed
• Upon termination, you will be responsible for any fees incurred up to the termination date
• We will provide access to campaign data and account information upon request

8. Money-Back Guarantee

We offer a 30-day satisfaction guarantee on our services. If you're not satisfied with the quality of our work within the first 30 days of engagement, you may request a full refund of management fees. Ad spend is non-refundable. This guarantee applies to monthly retainers only.
